The USPTO issued a memorandum today, in view of the Supreme Court Decision in Alice Corp. V. CLS Bank Int’l.
The memorandum provides immediately effective instructions to the patent examiners how to examine applications for patent eligible subject matter under 35 USC 101.
Applicants should consider their arguments, claim drafting, and specification drafting, in view of this official PTO guidance.
